Copyright and Trademark Notice Procedures

WebPower exerts no control over the content of web sites or persons who independently choose to link to WebPower/iFriends family of approved websites. WebPower expressly disclaims any and all liability regarding unauthorized third party usage of intellectual property. As an ISP we take claims of copyright and other intellectual property infringement seriously however, and fully comply with our legal obligations under the Digital Millennium Copyright Act when we receive a formal notice of infringement.


Digital Millennium Copyright Act (DMCA) Notice Procedure:

This service follows the procedures of the Digital Millennium Copyright Act (DCMA). If you believe that you have identified an instance of copyright infringement by one of our affiliates, please provide us with the following information:

• Identify with particularity the copyrighted work, personal likeness, or other intellectual property that you believe has been infringed. For example, "The property at issue is work that I own a copyright for, and is an image of..."

• Identify the allegedly infringing affiliate.

• Identify with specificity the content that you claim is infringing or has infringed on the work listed in item #1 above, including URL's and domain name on which the allegedly infringing material is located.

• Provide information reasonably sufficient to permit us to contact you by mail and email.

• Include the following statement: "I have a good faith belief that use of the copyrighted materials described above on the allegedly infringing web pages are not authorized by the copyright owner, its agent, or the law."

• Include the following statement: "I swear, under penalty of perjury, that the information in the Notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

• Send the notice via electronic or physical signature.

Upon receipt of the appropriate information identified above, WebPower will initiate an investigation. If WebPower, in its sole discretion, determines that you have raised a legitimate DMCA claim, WebPower may, in its sole discretion and without legal obligation to do so, notify the posting party, remove any disputed domain name and/or redirect the offending domain name to an alternative page. WebPower may, in its sole discretion, elect to disable and/or terminate the accounts of users who repeatedly infringe the copyrights or other intellectual property rights of others and document notices of alleged infringement on which we act. If a Notification of Claimed Copyright Infringement has been filed with us against an affiliate, the affiliate may file a Counter-Notification of Claimed Copyright Infringement.

You may want to seek independent legal counsel before filing a Notification of Counter-Notification.

Domain Name and Trademark Dispute Policy

If you believe a domain name or website is an infringement of your intellectual property, please submit a complaint using the contact information at the bottom of this policy.

Please include the following information in the notification:

• The trademark, service mark, trade dress, name, or other indicia of origin (the "Mark") that is claimed to be infringed;

Evidence that the party using the Mark that is claimed to be infringing is a ClickCash affiliate;

• The name, mailing address, telephone number, and email address of the owner of the Mark identified above;

• The goods and/or services covered by or offered under the Mark identified above;

• The date of first use of the Mark identified above;

• The date of first use in interstate commerce of the Mark identified above;

• The advertisement, text link, website or domain name you believe is in infringement of the Mark identified above;

• The goods and/or services covered by or offered under the Mark claimed to be infringing;

• The precise location of the advertisement, text link, website or domain name that is claimed to be infringing, including electronic mail address, etc; and

• A good faith certification signed under penalty of perjury, stating: (i) the Mark [identify mark] infringes the rights of another party; (ii) the name of such said party; (iii) the Mark [identify mark] being infringed, and (iv) that the use of the Mark [identify mark] claimed to be infringing at issue is not defensible.
